Taxes and holding structure in Florida

This is the front where the order of the decisions costs the most money. What is decided before the purchase is difficult and expensive to correct afterwards.

What we can say, and what we do not

A2B Relocation does not provide tax advice. What we do is make sure the questions reach the right professional at the right moment, and that the answers enter the written plan before the family commits to anything.

The reason is practical: the holding structure affects the purchase, the succession, the income generated by the property and the way a sale would be taxed in two countries. None of that is decided well after the fact.

The questions that should be answered before buying

  • Where you will be tax resident, and under which criteria
  • Whether the property is held personally, in an entity or in a trust — and why
  • What happens to the property in the event of death, in both jurisdictions
  • How income from rent, if any, will be declared and taxed
  • How the property would be sold, and what that would trigger
  • How the family's other assets are organised on the Brazilian side

The Florida part of the picture

Florida is known for not levying a state income tax on individuals, and this is one of the reasons families consider the state. It is not the whole picture: property tax is charged at state and county level, insurance in coastal areas carries real weight, and United States federal rules apply regardless of the state.

Anyone who presents Florida as a tax solution in itself is selling something. The analysis is of the family's structure, not of the state's reputation.

Succession is the part most often forgotten

A property held personally in the United States follows the succession rules of the place where it is located, while the family's assets in Brazil follow Brazilian rules. The two need to be read together, and read before the purchase.

Frequently asked questions

Does Florida have no income tax at all?

Florida does not levy a state income tax on individuals. Federal income tax still applies, and property tax and insurance are real costs. The effect on a specific family depends on how the income and the assets are structured.

Should I buy through a company?

Sometimes. The decision depends on the use of the property, on succession and on the family's wider structure. That analysis belongs to the attorney and the cross-border tax professional, and it should happen before the offer.

I keep my assets in Brazil. Does that change anything?

Yes. The two jurisdictions have to be read together, especially in matters of succession and of income generated abroad. This is why we bring the tax professional into the process early, and not only at the end.

This guide is general orientation about how a relocation process is organised. It is not legal, tax or immigration advice, and it does not replace an analysis of your own case by a licensed professional in the United States. Regulated work is carried out by the licensed partners we introduce.
